Following the mass de-registration of companies on 28 August by CIPC for outstanding annual returns, many businesses find themselves in a position where they need to re-instate their company or register a new one.

Section 82 of the Companies Act lays out various grounds for deregistration. If for whatever reason, CIPC does not receive a company’s annual return by the due date, they will assume that the company is inactive and will deregister it, following due process.
